These Terms of Service (the "Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the Bongo Bite website at www.bongobite.com (the "Site") and any related mobile or software applications ("Bongobite Platform") including but not limited to delivery of information via the website whether existing now or in the future that link to the Terms (collectively, the "Services").

 

Please read these Terms carefully. By accessing or using the Bongo Bite Platform, you are agreeing to these Terms and concluding a legally binding contract with Bongo Bite. You may not use the Services if you do not accept the Terms or are unable to be bound by the Terms. Your use of the Bongo Bite Platform is at your own risk, including the risk that you might be exposed to content that is objectionable, or otherwise inappropriate.

In order to use the Services, you must first agree to the Terms. You can accept the Terms by:

  • Clicking to Sign Up or Sign In button automatically accept or agree to the Terms, where it is made available to you by Bongo Bite in the user interface for any particular Service.

  • Actually using the Services. In this case, you understand and agree that Bongo Bite will treat your use of the Services as acceptance of the Terms from that point onwards.


 

Definitions:

  • Customer:

"Customer" or "You" or "Your" refers to you, as a customer of the Services. A customer is someone who accesses or uses the Services for the purpose of sharing, displaying, hosting, publishing, transacting, or uploading information or views or pictures and includes other persons jointly participating in using the Services including without limitation a user having access to 'restaurant business page' to manage claimed business listings or otherwise.

  • Content:

"Content" will include (but is not limited to) reviews, images, photos, audio, video, location data, nearby places, and all other forms of information or data. "Your content" or "Customer Content" means content that you upload, share or transmit to, through or in connection with the Services, such as likes, ratings, reviews, images, photos, messages, chat communication, profile information, or any other materials that you publicly display or displayed in your account profile. "Bongo Bite Content" means content that Bongo Bite creates and make available in connection with the Services including, but not limited to, visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate ratings, reports and other usage-related data in connection with activities associated with your account and all other elements and components of the Services excluding Your Content and Third Party Content. "Third Party Content" means content that comes from parties other than Bongo Bite or its Customers, such as Restaurant Partners and is available on the Services.


 

  • Restaurant:

For the purposes of these terms and conditions, the term "Restaurant" refers to any food establishment, including but not limited to restaurants, cafes, eateries, and other food vendors, that has registered on the Bongo Bite platform to offer its menu items for online ordering and delivery services. The Restaurant agrees to abide by the terms and conditions outlined herein, as well as any additional policies and guidelines provided by Bongo Bite. The responsibilities of the Restaurant include, but are not limited to, providing accurate menu information, fulfilling orders promptly, ensuring the quality and safety of food items, and cooperating with the Bongo Bite platform in the resolution of customer inquiries or disputes. The Restaurant acknowledges that it is an independent entity and is solely responsible for its products, services, and compliance with all applicable laws and regulations. The term "Restaurant" shall be interpreted accordingly within the context of the Bongo Bite platform.

  • Delivery Driver:

For the purposes of these terms and conditions, the term "Delivery Driver" or "Delivery Boy" refers to an individual or third-party entity engaged by Bongo Bite to provide delivery services for orders placed through the platform. The Delivery Driver is an independent contractor and is not an employee, partner, or agent of Bongo Bite or the participating restaurants. The responsibilities of the Delivery Driver include, but are not limited to, picking up orders from the designated restaurant, ensuring the safe and timely delivery of orders to customers, and adhering to traffic and safety regulations during the delivery process. Delivery Drivers are solely responsible for their mode of transportation, including but not limited to bicycles, motorcycles, cars, or any other means used for order delivery. Bongo Bite reserves the right to engage multiple Delivery Drivers to fulfill orders, and the specific terms of engagement may vary. Delivery Drivers are required to comply with Bongo Bite's policies, guidelines, and any additional instructions provided by the platform. It is understood that Delivery Drivers operate independently, and Bongo Bite shall not be held liable for their actions or conduct during the course of order fulfillment. The term "Delivery Driver" shall be interpreted accordingly within the context of the Bongo Bite platform

b. Payment for orders is processed securely through our designated payment gateway. And you can pay after delivery by COD (cash on delivery) using cash on delivery option.
